Terms of Service
1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the PhlebCare mobile application, related websites (including phlebcare.com), and our services made available through them (collectively, the “Service”). The Service is operated by the PhlebCare team (“we,” “us,” “our”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Nature of the Service
PhlebCare provides a software platform to help users request, schedule, and coordinate home phlebotomy and related medical testing services, including features such as appointment booking, service address and timing, document uploads (for example insurance or prescription materials where applicable), in-app messaging tied to bookings, optional live location updates during active service visits, notifications, and related account tools. Exact offerings depend on what is enabled in your region and in the app at the time of use.
The Service is a technology and logistics coordination tool. It is not a medical provider, laboratory, hospital, or pharmacy. We do not provide clinical diagnosis, treatment, or medical advice except as expressly stated for any informational content that is clearly labeled and non-clinical.
3. Eligibility and accounts
You must be legally able to enter a binding contract in Lebanon (or your place of residence, if different) and meet any minimum age we require in the app (typically at least 18, or the age of majority). You are responsible for providing accurate registration information and keeping your credentials confidential. You must promptly notify us of unauthorized access to your account.
Where the Service allows booking on behalf of another person, you represent that you have authority to provide their information and to bind them to these Terms where applicable.
4. User categories
Depending on configuration, accounts may include patients (or their representatives), phlebotomists or other field professionals, and organization users (for example lab or operations staff). Additional terms shown in-app (such as professional onboarding or verification steps) form part of your agreement when you use those features.
5. Bookings, fees, and payment
Bookings are requests subject to acceptance, capacity, and operational rules. Pricing, payment methods (such as cash or card where available), and invoicing are presented in the app or by the assigned provider as applicable. You agree to pay amounts you authorize. Taxes and third-party charges may apply according to applicable law.
We may cancel or refuse bookings that appear fraudulent, abusive, unsafe, or incompatible with operational requirements.
6. Cancellations and rescheduling
Cancellation and rescheduling rules, including any fees or cut-off times, are shown in the app or communicated through the Service. You agree to follow those rules. Repeated late cancellations or no-shows may result in restrictions on your account.
7. User content and documents
You may upload documents or images (for example insurance cards, prescriptions, or test-related files) as permitted by the Service. You represent that you have the rights to upload such content and that it is accurate to the best of your knowledge. You must not upload unlawful, misleading, or malicious content.
You grant us a limited license to host, process, and display your content solely to operate, secure, and improve the Service and to share it with personnel and systems that need it to fulfill bookings (for example assigned professionals and authorized organization users), as further described in our Privacy Policy.
8. Location
Where enabled, the Service may collect or display location information—for example service addresses, map display, and (during active visits) location updates to support routing or arrival-related features. You control certain location permissions through your device settings. Disabling location may limit features.
9. Communications
We may send transactional and operational messages (for example booking status, chat, or security notices) by push notification, email, SMS, or in-app channels, consistent with your settings and applicable law. Marketing communications, if any, will be sent in line with consent and preferences where required.
10. AI assistant
The Service may include an optional AI-powered assistant for general, non-emergency information. The assistant is not a doctor or other licensed clinician and does not provide medical advice, diagnosis, or treatment. Do not rely on it for emergencies; call local emergency services. AI responses may be inaccurate or incomplete. Use of the assistant is subject to fair-use and rate limits configured on our systems.
11. Third-party services
The Service relies on third-party infrastructure and APIs (for example cloud hosting, authentication, maps, geocoding, push notifications, and AI inference). Your use of the Service is also subject to those providers’ technical constraints and, where applicable, their terms. See our Privacy Policy for a non-exhaustive list of categories of processors.
12. Acceptable use
You agree not to:
- Use the Service for any unlawful, harassing, discriminatory, or fraudulent purpose.
- Attempt to bypass security, probe, or stress systems without authorization.
- Misrepresent your identity, credentials, or affiliation with any medical institution.
- Scrape, resell, or redistribute data from the Service except as expressly permitted.
- Upload malware or content that infringes third-party rights.
13. Intellectual property
We and our licensors own the Service, including software, branding, and content (excluding your uploads). We grant you a personal, non-exclusive, non-transferable license to use the Service in line with these Terms. You may not copy, modify, or create derivative works except as allowed by law or with our written consent.
14. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” We disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or that results obtained through the Service will meet your expectations.
15. Limitation of liability
To the fullest extent permitted by applicable law, we and our affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising out of or related to the Service or these Terms, even if advised of the possibility.
To the fullest extent permitted by applicable law, our aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to us for the Service in the three (3) months preceding the claim, or (b) fifty U.S. dollars (USD 50), except where limitation is prohibited by law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or willful misconduct where applicable.
16. Indemnity
You will defend, indemnify, and hold harmless PhlebCare and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
17. Suspension and termination
We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, pose a security risk, or if required by law. You may stop using the Service at any time. Provisions that by their nature should survive (including disclaimers, limitations, indemnity, and governing law) will survive.
18. Changes
We may modify these Terms by posting an updated version on this site and updating the “Last updated” date. For material changes, we will provide additional notice where required by law (for example in-app notice). Continued use after the effective date constitutes acceptance unless applicable law requires express consent.
19. Governing law and disputes
These Terms are governed by the laws of the Lebanese Republic, without regard to conflict-of-law rules that would apply another jurisdiction’s law, subject to mandatory consumer protections that may apply in your country of residence.
Unless mandatory law requires otherwise, you agree that the courts of Beirut, Lebanon have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, and you consent to personal jurisdiction there.
20. Miscellaneous
Entire agreement. These Terms and policies linked here (including the Privacy Policy) are the entire agreement between you and us regarding the Service.
Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Severability. If any provision is held invalid, the remainder remains in effect.
No waiver. Failure to enforce a provision is not a waiver.
Language. The English version controls unless mandatory local law requires another language.
